Concierge Membership Subscriber Agreement

1. Membership Program
MYDOCTORHOUSECALLS INC. d/b/a My Doctor House Calls ("MDHC") provides membership-based healthcare support services designed to improve access to primary care through home visits, telehealth services, care coordination, and related healthcare services.

Home Care Membership
- $299 per month
- 1 included home visit per month
- Unlimited member telehealth visits
- Assigned provider whenever possible
Enhanced Home Care Membership
- $499 per month
- 2 included home visits per month
- Unlimited member telehealth visits
- Priority scheduling and enhanced care coordination
- Assigned provider whenever possible
3. Membership Is Not Insurance
MDHC Concierge Membership is not health insurance, does not replace health insurance, and does not satisfy any legal requirement to maintain health insurance coverage. Members are encouraged to maintain appropriate health insurance coverage.
4. Insurance Billing
When permitted by law and payer requirements, MDHC may bill Medicare, Medicare Advantage Plans, commercial insurance plans, Medicaid where applicable, or other third-party payers for covered medical services provided to the Member. Membership fees are separate from insurance reimbursements. The Member remains responsible for applicable deductibles, co-payments, coinsurance, and non-covered services.
5. Membership Term
Membership begins on the enrollment date. All memberships require an initial minimum commitment of three (3) months. After completion of the initial commitment period, membership automatically renews on a month-to-month basis unless cancelled in accordance with MDHC policy.
6. Billing Authorization
By enrolling, the Member authorizes MDHC and its payment processor to charge the payment method provided for recurring membership fees. Membership fees are billed automatically each month. The Member is responsible for maintaining valid payment information.
7. Cancellation Policy
The Member may request cancellation at any time. No cancellation fee or early termination fee applies. However, membership fees continue through completion of the initial three-month commitment period. After completion of the initial commitment period, thirty (30) days written notice is required for cancellation.
8. Missed Visits
If a Member fails to attend a scheduled appointment, is unavailable at the scheduled time, or refuses access for a scheduled home visit without adequate notice, MDHC may treat the appointment as completed for purposes of monthly visit utilization. Repeated missed appointments may result in scheduling restrictions.
9. Home Visit Service Areas
Home visits are available only in geographic areas actively served by MDHC. Provider availability may vary based on provider coverage, travel requirements, weather conditions, and operational considerations. MDHC does not guarantee immediate availability in all locations.
10. Assigned Provider Model
MDHC utilizes a continuity-of-care model whenever possible. Members will generally be assigned to a primary MDHC provider who serves as the Member's principal provider for ongoing care, follow-up visits, preventive services, and care coordination.
MDHC will make reasonable efforts to maintain continuity with the same provider for established Members whenever operationally feasible. Provider assignments may occasionally change due to scheduling requirements, provider availability, illness, vacation, licensure requirements, geographic coverage needs, or other operational considerations. When the assigned provider is unavailable, MDHC may arrange care through another qualified MDHC provider to support continuity of services.
11. Telehealth Services
Telehealth services may be provided when clinically appropriate. Telehealth is not appropriate for all medical conditions. MDHC may recommend a home visit, urgent care, emergency department evaluation, or calling 911 when medically necessary.
12. Emergency Medical Conditions
MDHC does not provide emergency medical services. If the Member experiences a medical emergency, the Member should immediately call 911 or proceed to the nearest emergency department.
13. Prescription Policy
MDHC providers may prescribe medications when clinically appropriate and legally permitted. MDHC does not guarantee the issuance of any prescription, refill, controlled substance, or specific medication requested by a Member.
As a matter of organizational policy, MDHC providers do not prescribe opioid medications for chronic pain management. Members requiring chronic pain management, long-term opioid therapy, or specialized pain treatment may be referred to a qualified pain management specialist or pain management clinic for evaluation and ongoing treatment. All prescribing decisions remain within the professional medical judgment of the treating provider and applicable law.
14. Diagnostic and Ancillary Services
Certain services may be available for additional fees or insurance billing, including laboratory services, blood draws, retinal screening, bone density testing, EKG services, vaccinations, and other diagnostic testing. Availability varies by location and provider.
15. HIPAA and Privacy
MDHC maintains privacy and security practices designed to comply with applicable federal and state privacy laws, including HIPAA. The Member acknowledges receipt of MDHC's Notice of Privacy Practices.
16. Membership Changes
MDHC may periodically modify membership benefits, fees, and operational policies. Material changes will be communicated to Members before taking effect. No changes will alter obligations already incurred before the effective date of modification.
17. Suspension or Termination by MDHC
MDHC may suspend or terminate membership for threatening behavior, abusive conduct, repeated missed appointments, fraudulent activity, failure to maintain payment information, or violation of this Agreement. Any termination shall comply with applicable professional obligations and patient abandonment requirements.
18. Limitation of Membership Benefits
Membership benefits are personal to the enrolled Member and may not be transferred or assigned to another individual.
19. Governing Law
Except where otherwise required by applicable federal, state, or local law, this Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.
20. Acknowledgement
- Membership is not insurance.
- Membership requires a three-month minimum commitment.
- Membership automatically renews month-to-month after the initial term.
- Thirty days' notice is required after the initial commitment period.
- MDHC may bill insurance for covered services when appropriate.
- MDHC follows a continuity-of-care provider model whenever operationally feasible.
- MDHC providers do not prescribe opioids for chronic pain management under MDHC policy.
